DECISION
That the application be approved, subject to conditions.
CONDITIONS AND REASONS
1. The development must be begun within three years of the date of this decision.
Reason: Required to be imposed by Section 91 of the Town and Country Planning Act 1990, as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2. The development hereby permitted shall not be carried out other than to the approved drawings and specification of works noted thereon except where modified by the conditions of this consent. The approved drawings are Drawing Numbers:
Location plan, received 14.11.24 Existing floor plans, received 14.11.24 Existing elevations and roof plans (Rev A), received 23.12.24 Existing and proposed site layout (Rev A), received 23.12.24 Proposed floor plans and elevations, received 01.04.25
Reason: To ensure the development is implemented in accordance with the approved plans and to avoid ambiguity; and to preserve the character and special interest of the building in accordance with Policy HE3 of Burnley’s Local Plan (July 2018).
3. All materials to be used in the approved scheme shall be as stated on the approved drawings, shall be retained thereafter as such and not be varied without a further planning permission first having been granted.
Reason: To ensure that the development will be of a satisfactory appearance in accordance with Policies SP5 and HE3 of Burnley’s Local Plan (July 2018).
4. Any works of making good to the retained fabric, shall be finished to match the adjacent work with regard to the methods used and to colour, material, texture, and profile, except where indicated otherwise on the drawings hereby approved.
Reason: In order to safeguard the special architectural and historic interest of the locally listed building and to comply with Policy HE3 of Burnley’s Local Plan (July 2018).
5. Notwithstanding the provisions of Part 1 of the Second Schedule of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (or any order revoking or re-enacting that Order with or without modification; no new windows or juliet balconies shall be installed in the extension hereby approved without a further planning permission first having being granted.
Reason: In the interests of visual amenity and to protect the privacy of the occupiers at No. 64 Halifax Road (The Hill) in the interest of residential amenity, and to accord with Local Plan Policies HE3, SP5, HS4 and HS5.
6. There shall be no burning of construction-derived waste or other materials within the curtilage of the premises.
Reason: to protect the amenities of nearby residents (in relation to odour from smoke) in accordance with policy NE5 and SP5 of the Local Plan.
