To determine an application to vary a Premises Licence to change the Designated Premises Supervisor (DPS) at the under the Licensing Act 2003 at the Turf Hotel, 49 Yorkshire Street, Burnley, BB113BW.

John Clucas outlined the reason for the hearing in relation to an application to vary the Designated Premises Supervisor (DPS) at the Turf Hotel,49 Yorkshire Street, Burnley,BB11 3BW, and presented a report to Members on behalf of the Licensing Authority relating to Regulation 26 (1) of the Licensing Act 2003.

 

Police Constable Michael Jones and Sergeant Gary Hennighan from Lancashire Constabulary presented the case on behalf of the Police regarding the Variation of the DPS from Joshua Daniel Greenwood-Sutton to Bobby Carter.

 

Gill Sherratt presented the case on behalf of Terry Grogan (present), who was the Premises Licence Holder on behalf of MGB (Burnley) Ltd, and Bobby Carter (present) as the DPS, of the Turf Hotel,49 Yorkshire Street, Burnley,BB11 3BW .

 

The Police, after discussions with the Premises representatives, recommended to Members not to remove Bobby Carter from his post as DPS.

 

DECISION AND REASON FOR DECISION

 

Decision

That the application be granted by the Committee that Bobby Carter to remain as the DPS of the Turf Hotel,49 Yorkshire Street, Burnley,BB11 3BW, and that the guarantee from the Premises to provide support to Bobby Carter be noted.

 

Reasons for Decision

 

That based on the evidence presented that removal of Bobby Carter as DPS was not appropriate in order to meet the licensing objective of the prevention of crime and disorder.
