To determine a Premises Licence application under the Licensing Act 2003 relating to Williams Lounge Bar, 7 Yorke Street, Burnley, BB11 1HD.

John Clucas outlined the reason for the hearing in relation to an application for a Premises Licence at the Williams Lounge Bar, 7 Yorke Street, Burnley,BB11 1HD. and presented a report to Members on behalf of the Licensing Authority relating to Section 17 of the Licensing Act 2003.

 

Ian Snowden, as a Director of Burnley Taverns Ltd, presented objections to the application for a premises licence at Williams Lounge Bar.

 

Keira Crossley, as the proposed Designated Premises Supervisor, and Eddie Crossley presented their case to apply for a premises licence at Williams Lounge Bar.

 

DECISION AND REASON FOR DECISION

 

Decision

(1)  That the following findings were made:

 

(a)  That following comments by the objector regarding the legality of the legal process used by the applicant when applying for the licence, that there was no flaw in that legal process;

 

(b)  That the comments made by the objector regarding fire safety had been taken into account, and notwithstanding that the fire authority has not made any representations, it was recommended that the applicant contacts them to arrange a visit to the premises;

 

(c)  That following comments made by the objector regarding drinking up time, this is an issue for the licence holder to manage and for the licensing team to enforce.

 

(2)  That the application for the licence be granted as applied for that being for all the standard hours requested by the applicant for live music (Sun to Thurs noon to 11pm, and Fri and Sat noon to midnight), for recorded music (Sun to Wed 9am to 11pm, and Thurs to Sat 9pm to 3am), and for the sale of alcohol (Sun 9am to midnight, Mon to Wed 8am to 1am, and Thurs to Sat 8am to 3.30am);

 

(3)  That the licence not be granted in relation to the non-standard hours from 8am to 4am relating to live music, recorded music, and for the sale of alcohol;

 

(4)  That a number of conditions be added to the licence to address concerns in the following areas, subject to the exact content being approved by the licensing authority, and that the operating schedule be updated as appropriate. Those conditions being regarding:

(a)  Challenge 25;

(b)  Door Supervisors-particularly in the evening and on Burnley FC Home match days; and

(c)  CCTV.

 

 

 

 

 

Reasons for Decision

 

That based on the evidence presented the decisions made were reasonable and proportionate regarding the relevant licensing objectives.
