It was resolved, in accordance with section 100A(4) of the Local Government Act 1972, to exclude the public from the meeting during consideration of agenda items 3 and 4 in order to receive information in relation to any action taken or to be taken in connection with the prevention, investigation or prosecuting of crime

To determine an Expedited (Summary) Review Application submitted by Lancashire Police in respect of The Angel Inn,80  Accrington Road, Burnley, BB11 4AU in advance of a full review hearing which will be held within 28 days of the application being made (i.e. on or before 16th December).

The Committee considered a report requesting determination of an expedited (Summary) Review application which had been submitted by Lancashire Police in relation to the Premises Licence in respect of  The Angel Inn, 80 Accrington Road, Burnley, BB11 4AU in advance of a full hearing which would be held within 28 days of the application being made which would be held in advance of a full review hearing which will be held within 28 days of the application being made which would be on or before 16th December 2020.

The Police and Premises License Holder have been invited to submit written representations for consideration.  If received these will be forwarded.

Karen Davies, Local Authority Environmental Health and Licensing Manager outlined the grounds for the hearing in relation to the application.  A copy of the application from Lancashire Constabulary was attached to the report at Appendix B.  A copy of the current Premises Licence was attached to the report at Appendix A.  Also attached to the report was a copy of the Certificate received from the Lancashire Constabulary under section 53A(1)(b) of the Licensing Act 2003 in relation to the application.

 

Written representations received from Jackie Davies, Premises Licences holder and DPS at the Angel Inn had been circulated to the panel and were considered by the panel.

DECISION

Minutes:

At this point, the meeting was made available for public access.

 

That, with immediate effect, and pending the determination of the review, the Premises Licence for The Angel Inn, 80 Accrington Road, be suspended.

21.

REASON FOR DECISION

Minutes:

The Sub-Committee considered this interim step to be appropriate, necessary and proportionate to promote the licensing objectives relating to the prevention of crime and disorder, public safety and the prevention of public nuisance for the following reasons:

 

The Police evidence linking the premises to serious crime, which has taken place notwithstanding and alongside previous enforcement action, is such that it is necessary to suspend licensable activities to reduce the risk of the premises continuing to be used without reasonable steps having been taken to keep works (including volunteers), customers and visitors safe during the Covid-19 pandemic by complying with the relevant government regulations and social distancing guidelines, on or at the premises.

 

David Talbot, Council Legal Representative advised the Committee of the further hearing procedures available to the Premises Licence Holder.

 

The Committee was also advised 4th December at 11am had been scheduled for the final review hearing.
