To approve as a correct record the Minutes of the last meeting, held on 6th November 2024.

To receive any declarations of interest from members relating to any item on the agenda in accordance with the provisions of the Code of Conduct.

The Committee considered a report relating to an application for consent to conduct an exhibition, demonstration or performance of hypnotism for an event to be held at Paradise Working Men’s Club on Sunday 1st December, between the hours of 2.00pm and 7.00pm, with a maximum of 250 people to be admitted to the venue.

 

A special meeting of the Committee had been convened as there was currently no provision in the Council’s Constitution for applications for consent of this nature to be dealt with by Officers or a sub-committee as they were for premises licences. The Constitution would be amended accordingly in due course.

 

Lisa Tempest presented the report on behalf of the Licensing Authority and responded to questions from the committee.

 

Mr Adamson said he had nothing further to add to the application as presented but responded to a number of questions from the committee about his experience and how he would adapt his performance to make it age appropriate to the audience on the day.

 

Members RESOLVED to go into private session to consider the application for consent.

 

RESOLVED – DECISION AND REASONS FOR DECISION

 

The Licensing Committee took account of relevant Guidance relating to the Licensing Act 2003. The Committee particularly had in mind the Licensing Objectives relating to the Prevention of Crime and Disorder, Public Safety, the Prevention of Public Nuisance, and the Protection of Children from Harm and in addition took account of The Hypnotism Act 1952 and Home Office circular 39/1996 Stage Hypnotism.

 

The Licensing Committee carefully considered the written representations made by the Applicant and the conditions suggested by the Licensing Authority attached at appendix B of the Licensing Committee report.

 

RESOLVED That the Application for Consent to conduct an exhibition, demonstration or performance of hypnotism on the 01 December 2024 at Paradise Working men’s club, Burnley between the hours of 2.00pm and 7.00pm with a maximum number of 250 people to be admitted to the venue, be granted.

 

REASONS

 

The Licensing Committee noted that the Applicant has extensive experience in this field.  The Applicant provided details of three most recent previous performances and no issues were reported. 

 

The Applicant has shown their understanding of the Licensing Objectives and agreed to conditions suggested at appendix B of the licensing report.

 

The decision to grant is appropriate, necessary and proportionate in the circumstances for the promotion of all four licensing objectives.
