To approve as a correct record the Minutes of the last meeting as enclosed.

The minutes of the previous meeting held on 20th November 2019 were approved as a correct record.

Licensing Act 2003 Burnley Borough Council Licensing Policy pdf icon PDF 110 KB

To consider the draft Licensing Policy and agree to it being sent out for a formal 8 week consultation.

A report was submitted requesting approval of a formal eight-week consultation process regarding the draft Licensing Act 2003 Statement of Licensing Policy 7th January 2021 to 6th January 2026.  A copy of the draft policy was attached to the report for information.  Amendments to the report had been highlighted to assist consultees.

 

The Committee was advised of the existing policy period (January 2016 to January 2021)   and of the requirement to be revised, updated, agreed by full Council, and published prior to January 2021.

 

The Committee was reminded of the requirement when updating the policy for responsible authorities to be included within the consultation process.

 

The Committee was advised that a pre-consultation draft had been circulated to key members and that no responses had been received.  Details of the consultation process were outlined within the report.     

 

RESOLVED

 

That the Licensing Committee approve a formal eight-week consultation process of the draft Licensing Act 2003 Statement of Licensing Policy, 7th January 2021 to 6th January 2026, including responsible authorities, as outlined in the report.

 

 

At this point, due to technological difficulties, Mr James Astin, Licensing and Compliance Officer was unable to access the remote meeting to present agenda item 8 to the Committee. It was suggested, and agreed by the Committee that agenda item 9, as detailed below would be presented to the Committee prior to item 8, to enable Mr Astin the opportunity to attempt to rejoin the remote meeting.

 

 

 

 

 

 

3.

Appointments to Sub Committees pdf icon PDF 130 KB

To consider the arrangements for the holding of Licensing Act 2003 hearings and Taxi Licensing hearings for 2020/21.

Minutes:

A report was submitted requesting that consideration be given to the sub-delegation of functions to a Licensing Act 2003 Sub Committee for a final hearing procedure and to a Taxi Licensing Sub Committee for functions relating to taxi and private hire licences.

 

Grounds for the request were outlined within the report.

 

RESOLVED

 

1. That a Licensing Act 2003 Sub Committee be established for the sub delegation of functions under the Licensing Act 2003 for a final hearing procedure; and

 

2. That Taxi Licensing Sub Committees be established for sub delegation of functions vested in the Licensing Committee relating to taxi licensing functions as set out in Part 3 of the Council’s Constitution; and

 

3. That members be appointed to the sub committees on a rotational basis subject to their availability.

Review of Private Hire Operator and Vehicle Licence Conditions pdf icon PDF 299 KB

To consider proposed revisions to private hire operator and vehicle licence conditions including pre-licence requirements.

Minutes:

A report was submitted by Mr James Astin requesting that the Licensing Committee approve proposed revisions to private hire operator and vehicle conditions, including pre-licensing requirements, with immediate effect.  Copies of the revised conditions were attached to the report at appendices A and B.  Revisions to the conditions and pre-licence requirements were highlighted within the report.

 

Grounds for the requested revisions were outlined within the report.  Details of consultees, which had included the Taxi Task Group Trade Representatives were also outlined within the report.

 

RESOLVED

 

That the Licensing Committee approve the revisions made to private hire operator conditions and private vehicle conditions relating to pre-licence and ongoing requirements, as outlined in appendices A and B, with immediate effect.
