Re-convening of the hearing of 15th September 2022

Minutes:

The adjourned Licensing Act 2003 hearing of 15th September 2022 reconvened.  The hearing related to three Temporary Event Notices (TENs) for Electric Circus, 51 Bank Parade, Burnley following the submission to the Licensing Authority of an objection from Environmental Health.

 

 

Councillor Anne Kelly remained in the Chair.

The Chair noted that the Noise Impact Assessment had been received as requested.

 

Karen Davies attended the hearing on behalf of the Licensing Authority.

 

Jill Wolfendale attended the hearing on behalf of Environmental Health.

 

Mr Ray Harrison (premises owner) attended the meeting.

 

Members and all parties present asked questions.

 

The Temporary Event Notices have been determined with a view to promoting the four licensing objectives but, in particular, the licensing objectives relating to Public Safety, Prevention of Crime & Disorder and Protection of Children from Harm.

 

The Sub-committee carefully considered the report of the Licensing Officer and the representations made by Environmental Health.

 

The Sub-committee has had regard to the Temporary Event Notices and the relevant representations received.

 

The Sub-committee has had regard to the s182 Guidance issued by the government.

 

The Sub-committee has had regard to its own Statement of Licensing Policy.

 

Having taken all of the above into consideration IT WAS RESOLVED:

That the three TEN applications in respect of 1st October, 15th October and 22nd October be granted as set out in the applications, on condition that the conditions below taken from the Premise licence PLA0444, to apply to all three Tens’: -

‘Annex 1 - Mandatory Conditions’ in respect of the Sale of Alcohol

‘Annex 2 - Conditions Imposed in Accordance with the Operating Schedule & Under Paragraph 18 (4) & 18 (5) Schedule 8 of the Licensing Act 2003’ to be applied in full.
